Some of the things that Kevin McGuigan has accomplished over the years includes the successful negotiation with the Provincial and Federal regulatory authorities to allow a slate mine to access a deposit of slate that was only accessible on Crown land and by going through a National Park. Kevin McGuigan has bene involved in litigation to define when a party has to produce records that are relevant to the pleadings and issues raised in litigation (Marion v. Wawanesa Mutual Insurance Company, 2004 ABCA 213). And Kevin McGuigan was involved in getting the Court of Appeal to set the test for seeking to appeal interim orders in an action (Jeerh v. Yorkton Securities Inc., 2005 ABCA 64) to determine when and how an appeal should be presented, as the Alberta Rules of Court were amended to address interim appeals. Kevin McGuigan has also successfully argued against people having vicarious liability for the work of tradespeople that have provided construction services to a home and defects being discovered after it was sold (Phillips v. Messier). Kevin has also run trials in other provinces. And he has run trials to deal with issues of toxic mold and latent defects in commercial buildings when there are disputes on the sale of properties.
